Annulment

In an action for annulment, the Court can dissolve the marriage and adjudge it “null and void.” In Arizona, the court must find that there was an impediment that renders the marriage “null and void.” Examples of possible grounds for filing an annulment include:

  • A blood relationship exists
  • A prior marriage was not dissolved when the current marriage took place
  • One party was underage
  • Failure to consummate the marriage
  • One party was mentally or physically incapacitated
  • Intoxication of one party
  • One party was under duress
  • Fraud or misrepresentation when entering into the marriage
